1. Introduction

If you do not agree with any part of these Terms, please do not use the Site or engage our services.

2. Definitions

• “Client”, “you”, or “your” means the person or entity submitting a sample, inquiry, or engaging services from TisconLab.

• “Services” means any testing, inspection, certification, analysis, reporting, consultancy, or related service offered by TisconLab.

• “Sample” means the physical product, material, or item submitted to TisconLab for testing or analysis.

• “Report” means the test report, certificate, or document issued by TisconLab after completion of the Service.

• “Quote” means the commercial quotation issued by TisconLab based on the scope of the Services.

• “Scope” means the testing standards, methodology, acceptance criteria, and other parameters as agreed in writing between the Client and TisconLab.

3. Quotation, Acceptance & Scope

• All service requests must include complete technical details (product specifications, relevant standards such as IS/ASTM/IEC, and acceptance criteria).

• TisconLab will review the request, confirm feasibility under NABL/ISO 17025:2017 accreditation, and issue a formal quotation.

• Acceptance of the quotation (by written confirmation or by sample submission) constitutes agreement to the Scope and these Terms.

• Any modifications to the Scope shall require written approval and may result in additional costs or schedule adjustments.

4. Sample Submission, Preparation & Testing

• Samples must be properly labelled and accompanied by relevant documentation upon submission.

• Each Sample is assigned a unique ID for tracking within TisconLab’s system and handled as per our Standard Operating Procedures (SOPs).

• Tests are performed under standard laboratory conditions unless otherwise specified in writing.

• Delays due to incomplete documentation, damaged samples, or changes in Scope are the Client’s responsibility.

5. Reports & Use of Results

• Upon completion, TisconLab will issue a draft report (if applicable) for review, followed by the final signed report.

• Reports are valid only for the specific sample(s) tested and the stated Scope.

• Reports must not be altered, reproduced partially, or used for misleading promotion.

• TisconLab shall not be liable for any misuse, misinterpretation, or alteration of test results.

6. Fees, Payment & Delivery

• Service fees are as per the accepted quotation. Payments must be made within the terms stated in the invoice (typically within 30 days).

• TisconLab reserves the right to withhold or delay reports if payments are pending.

• Delivery schedules are estimates and may vary due to technical or operational factors.

7. Confidentiality & Intellectual Property

• Both TisconLab and the Client shall maintain strict confidentiality regarding proprietary or sensitive information.

• Reports, testing methodologies, and other documentation remain the intellectual property of TisconLab.

• The Client grants TisconLab permission to handle and analyze submitted samples solely for the agreed purpose.

8. Website Use & Disclaimer

• All information provided on this Site is for general informational purposes only and does not constitute professional or legal advice.

• TisconLab strives to ensure the Site’s accuracy and availability but does not warrant that it will be error-free or uninterrupted.

• Use of the Site and its content is at your own risk. TisconLab shall not be liable for any damages resulting from such use.

9. Limitation of Liability

• TisconLab’s total liability for any claim arising from a Service shall not exceed the amount paid by the Client for that Service.

• TisconLab shall not be liable for indirect, incidental, or consequential damages, including loss of profit or data.

• Nothing in these Terms limits liability for death, personal injury, or fraud caused by negligence.

10. Force Majeure

TisconLab is not responsible for delays or failure to perform due to circumstances beyond reasonable control, including natural disasters, power failures, or government restrictions.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra. Disputes shall first be attempted to be resolved amicably before arbitration as per the Arbitration and Conciliation Act, 1996.

12. Changes to Terms

TisconLab may revise these Terms at any time without prior notice. The latest version will be available on this Site, and continued use implies acceptance of any modifications.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.
